Three men arrested in Cushing, Oklahoma drug bust face hearing

Three men from out of town who were arrested together during a drug raid at a Cushing home in July are facing separate preliminary hearings in Payne County on charges of trafficking in cocaine and possessing marijuana with intent to distribute.

Former Cushing, Oklahoma resident Byron Henry Warner, 26, remains jailed in lieu of $60,000 bail pending an Oct. 24 preliminary hearing on two different drug cases.

Warner, who said he was unemployed and living with his mother in Muskogee at the time of his July arrest, was charged four months earlier with having delivered cocaine over two years ago in Cushing, Oklahoma to a confidential informant for the Oklahoma state narcotics bureau.

An affidavit by Stephen Gibson, agent with the Oklahoma Bureau of Narcotics and Dangerous Drugs Control, alleged that on May 1, 2001, at 3 p.m., he and a confidential informant purchased four grams of cocaine base from Warner for $400 at Warner's then-residence at 722 North Cleveland in Cushing, Oklahoma.

Cushing, Oklahoma Police Sgt. Mike Morton provided surveillance during the alleged 2001 transaction, according to the affidavit filed with the charge on March 27, 2003.

In the case stemming from a Cushing drug raid at 912 West Broadway about 6 a.m. July 24, Warner has been charged along with two other out-of-town men, Alonzo Kellth Prince, 23, of Oklahoma City, and Truman Marquise Berry, 32, of Tulsa, Oklahoma.

Prince, who is free on $25,000 bail, faces an Oct. 31 preliminary hearing.

Berry, who is also free on $25,000 bail, has a Dec. 17 preliminary hearing.

All three defendants could receive life prison sentences if convicted of the drug charges, to which they have pleaded innocent.

An affidavit by John Stanbery, an agent with the District Attorney's Drug Task Force, said that officers from the Cushing and Stillwater Police Departments, along with the Drug Task Force, were involved in serving a search warrant at the West Broadway residence.

All three defendants were located in the front living room where on the floor, drug task force agents found a can of Brut deodorant with a false bottom, the affidavit said. The can had three plastic baggies containing creme-colored rocks weighing about 9.2 grams, one baggie containing three pink pills and one baggie containing 1.9 grams of broken white tablets, the affidavit alleged.

A clear plastic baggie containing about 2.6 grams on marijuana was found on a kitchen counter, the affidavit alleged.

A can of Ajax with a false bottom containing 20 individual baggies of marijuana with a total weight of 135.9 grams was found in a kitchen cabinet, the affidavit alleged.

A can of Airwick Wizard with a false bottom containing one baggie with several creme-colored rocks with a total weight of 1.5 grams and $75 was also found in the house, the affidavit alleged.

A can of STP with a false bottom containing one white bag with marijuana residue and $400 was also found in the house, the affidavit alleged.

After the search was completed, the house was released to the homeowner, who was not identified in court documents, Stanbery's affidavit said.

The homeowner contacted the DA's Drug Task Force agents and advised that a firearm had been located at the residence, the affidavit said. The homeowner had found a Titan Tiger 38 special pistol wrapped in a red rag partially concealed in an outbuilding to the residence, the affidavit alleged.
